• Prices, Billing and Payment Policies
  • A faxed or emailed notice will be delivered to any client whose payments are overdue. If these accounts have not been paid a week after these notices have been sent then the account will be suspended.
  • A cancellation request regarding Domain name registration or Web Hosting must be handed in writing to Onswaziline within 30 days before the anticipated date of termination of service. The cancellation request must be on a company letterhead and must specify the hosting account/s which is being cancelled.
  • Payments for services may be rendered in Emalangeni and Rands. Contact us if you wish to use US Dollars, Pounds or Euros.
  • Onswaziline reserves the right to change prices at any time depending on the cost we are charged by our hosting provider.
  • Payments may be made via electronic bank transfers or by paying cash at our office.
• Content
  • We offer the use of server space for email accounts and for hosting of web and WAP sites.
  • A web hosting account may be used for only one website. We prohibit the use of one web hosting account for more than one website. Nonetheless, subdomains may be used as an extension of the main website or as a WAP site to run alongside the main website. Subdomains may not be used to host additional websites.
  • We do not deliberately monitor the content of our clients publish on the web but our clients are expected to observer all local, common, national or international laws or regulations with respect to their content. Any content that is questionable may be removed by our webhost provider without notice.
  • Content that:
    • Is Illegal and use of material without copyrights, such as commercial audio, video or music files
    • adult material, such as pornography, erotic images or otherwise lewd or obscene
    • Racist, defamatory, obscene, indecent or other unlawful material
    • 'Wares', such as pirated software, ROMS, emulators, instructions or software for phreaking, hacking, password cracking or IP spoofing etc
• Upgrading Web Hosting Accounts
  • Clients may upgrade their webhosting accounts as required. This may be done immediately or at an agreed convenient date.
• Data Transfer (Bandwidth) and System Resources
  • All web hosting accounts should remain within the agreed data transfer allowance. There may be times when sites exceed their limit but as long as this is for a short infrequent period, we will not charge for the exceeded amounts.
• Spam (unsolicited email)
  • Onswaziline prohibits spam (the sending of unsolicited bulk email) from email accounts linked to your webhosting. Permission to send bulk unsolicited emails is at the discretion of our webhosting services provider hence it is important to inform us about any intent to send bulk emails.
• Indemnification
  • Onswaziline assumes no liability for any loss, injury, claim, liability or damage of any kind - including loss of business, lost profits, lost data, or failure of security - resulting in any way from the use of the Hosting, including without limitation any errors or omissions, any content, any delay or failure of performance, or the unavailability or interruption of service. THE PROVIDER SHALL NOT BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES OF ANY KIND WHATSOEVER, WHETHER OR NOT FORESEEABLE (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE WEB HOSTING SERVICES OR THE FAILURE OF A PARTY TO PERFORM ITS OBLIGATIONS, REGARDLESS OF ANY PARTY'S NEGLIGENCE. ONSWAZILINE ALSO AGREES TO INDEMNIFY AND HOLD HARMLESS Provider FROM ANY CLAIMS RESULTING FROM THIS AGREEMENT. Termination of this Agreement shall be ONSWAZILINE's sole and exclusive remedy for any and all damages or injury.
• Acts Beyond Our Control
  • We shall not be deemed in breach if our obligations are delayed or prevented by reason of any act of God, fire, natural disaster, accident, riots, acts of government, shortage of materials or supplies, failure of transportation or communication, third party non-performance (including, without limitation, the failure or performance of common carriers, interexchange carriers, local exchange carriers, suppliers and subcontractors), or any other cause beyond our reasonable control
• Disclaimer
  • With respect to the Hosting, Provider provides services to ONSWAZILINE clients on an "as is" basis. PROVIDER EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
